The flight delays are governed by Community Regulation (EC) no. 261/2004 dated 11/02/2004, published in G.U. L. 46/1 of 17/02/2004, which established “Common rules on compensation and assistance for passengers in the event of denied boarding, cancellation and long delay”. Following judgment no. 402 of 19/11/2009 of the European Court of Justice, delayed flight passengers have been treated as flights canceled (where Article 7 of EC Regulation 261/2004 applies) in case, due to airplane delay, they will experience a loss of three hours or more, ie when they arrive at their final destination three hours or more after the time of expected arrival provided by the air carrier.
